ALGEMENE VOORWAARDEN – LEMANTÁ PHORIPE

Artikel 1 – Identiteit van de ondernemer

Artikel 2 – Toepasselijkheid

  1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van Lemantá Phoripe en op elke tot stand gekomen overeenkomst via de webshop.
  2. Door een bestelling te plaatsen gaat de klant akkoord met deze voorwaarden.

Artikel 3 – Het aanbod

  1. Lemantá Phoripe doet haar best producten zo nauwkeurig mogelijk te beschrijven en af te beelden.
  2. Kennelijke fouten of vergissingen in het aanbod zijn niet bindend.

Artikel 4 – De overeenkomst

  1. De overeenkomst komt tot stand op het moment dat de klant een bestelling plaatst en deze door Lemantá Phoripe wordt bevestigd.
  2. Lemantá Phoripe behoudt zich het recht voor bestellingen te weigeren bij gegronde redenen, zoals fraude of misbruik.

Artikel 5 – Prijzen

  1. Alle prijzen zijn in euro’s en inclusief btw.
  2. Verzendkosten:
    • Gratis verzending bij bestellingen boven €50
    • Voor bestellingen onder €50 kunnen verzendkosten in rekening worden gebracht

Artikel 6 – Levering

  1. Levering vindt plaats via een externe vervoerder.
  2. Levertijden:
    • Nederland: 1–3 werkdagen
    • Europa: 3–7 werkdagen
  3. Overschrijding van de levertijd geeft geen recht op schadevergoeding, tenzij wettelijk verplicht.

Artikel 7 – Herroepingsrecht (Retour)

  1. De klant heeft het recht de bestelling tot 14 dagen na ontvangst zonder opgave van reden te annuleren.
  2. Na annulering heeft de klant nogmaals 14 dagen om het product retour te sturen.
  3. Voorwaarden voor retour:
    • Het product is ongebruikt
    • Het product verkeert in originele staat
    • Het product zit in de originele verpakking
  4. De kosten voor retourzending zijn voor rekening van de klant.
  5. Lemantá Phoripe zal het aankoopbedrag binnen 14 dagen na ontvangst van de retourzending terugbetalen.
  6. Indien het product beschadigd of gebruikt is, kan de waardevermindering worden doorberekend.

Artikel 8 – Uitsluiting herroepingsrecht

Het herroepingsrecht kan worden uitgesloten voor producten die om hygiënische redenen niet geschikt zijn om te worden geretourneerd en waarvan de verzegeling is verbroken.

Artikel 9 – Betaling

  1. Betaling dient te geschieden via de betaalmethodes die worden aangeboden in de webshop.
  2. Bestellingen worden verwerkt nadat de betaling is ontvangen.

Artikel 10 – Garantie en conformiteit

  1. Lemantá Phoripe staat ervoor in dat de producten voldoen aan de overeenkomst en de redelijke verwachtingen die de klant ervan mag hebben.
  2. Bij een defect of ondeugdelijk product heeft de klant recht op vervanging of terugbetaling.
  3. Klachten over gebreken dienen binnen 3 maanden na ontdekking gemeld te worden via info@lemantaphoripe.nl.

Artikel 11 – Klachtenregeling

  1. Klachten kunnen worden gemeld via info@lemantaphoripe.nl.
  2. Lemantá Phoripe streeft ernaar klachten binnen 14 dagen te behandelen.

Artikel 12 – Aansprakelijkheid

  1. Lemantá Phoripe is niet aansprakelijk voor indirecte schade.
  2. De aansprakelijkheid is beperkt tot het bedrag van de aankoop.
  3. Wettelijke consumentenrechten blijven onverminderd van kracht.

Artikel 13 – Toepasselijk recht en geschillen

  1. Op deze algemene voorwaarden is Nederlands recht van toepassing.
  2. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.

Article 2 – Applicability

  1. These Terms and Conditions apply to every offer made by Lemantá Phoripe and to every agreement concluded via the webshop.
  2. By placing an order, the customer agrees to these Terms and Conditions.

Article 3 – The Offer

  1. Lemantá Phoripe strives to describe and display products as accurately as possible.
  2. Obvious errors or mistakes in the offer are not binding.

Article 4 – The Agreement

  1. The agreement is concluded when the customer places an order and it is confirmed by Lemantá Phoripe.
  2. Lemantá Phoripe reserves the right to refuse orders for valid reasons, such as suspected fraud or misuse.

Article 5 – Prices

  1. All prices are in euros and include VAT.
  2. Shipping costs:
    • Free shipping on orders above €50
    • Shipping costs may apply for orders below €50

Article 6 – Delivery

  1. Delivery is carried out by an external carrier.
  2. Estimated delivery times:
    • Netherlands: 1–3 business days
    • Europe: 3–7 business days
  3. Delays in delivery do not entitle the customer to compensation, unless required by law.

Article 7 – Right of Withdrawal (Returns)

  1. The customer has the right to cancel the order within 14 days after receiving the product, without giving any reason.
  2. After cancellation, the customer has an additional 14 days to return the product.
  3. Return conditions:
    • The product must be unused
    • In original condition
    • In original packaging
  4. Return shipping costs are the responsibility of the customer.
  5. Lemantá Phoripe will refund the purchase amount within 14 days after receiving the returned product.
  6. If the product is used or damaged, a reduction in value may be applied.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that are not suitable for return due to hygiene reasons and whose seal has been broken.

Article 9 – Payment

  1. Payment must be made using the payment methods offered in the webshop.
  2. Orders will be processed after payment has been received.

Article 10 – Warranty and Conformity

  1. Lemantá Phoripe guarantees that the products comply with the agreement and meet reasonable expectations.
  2. In case of defective or faulty products, the customer is entitled to replacement or a refund.
  3. Complaints regarding defects must be reported within 3 months after discovery via info@lemantaphoripe.nl.

Article 11 – Complaints Procedure

  1. Complaints can be submitted via info@lemantaphoripe.nl.
  2. Lemantá Phoripe aims to handle complaints within 14 days.

Article 12 – Liability

  1. Lemantá Phoripe is not liable for indirect damages.
  2. Liability is limited to the purchase amount of the product.
  3. Statutory consumer rights remain unaffected.

Article 13 – Governing Law and Disputes

  1. These Terms and Conditions are governed by Dutch law.
  2. Any disputes shall be submitted to the competent court in the Netherlands.
